How do I make an enduring power of attorney

You will need to get a doctor and another healthcare professional to assess your capacity and confirm you are able to enter into the agreement. You will also need to talk to a lawyer, who will make sure you understand the agreement.

You must tell certain people about the arrangement after you have created it, like your spouse/civil partner and adult children. If you do not, your enduring power of attorney will not be valid.

If you lose your capacity to make certain decisions in the arrangement, your attorney must register it with us. They must tell certain people when they apply to register it, like your spouse/civil partner and adult children. They also have to provide them with a copy of the arrangement.
