Code of Practice for Supporting Decision-Making and Assessing Capacity
This code of practice provides guidance on supporting people with decision-making capacity challenges to make certain decisions. This includes information and guidance on following the guiding principles in the Act and understanding how and when to assess capacity.
This code is for anyone who engages with a person with decision-making capacity challenges. This code is mandatory for an intervener under the Act, but also provides broader guidance on best practice for interacting with a relevant person.
Instead of duplicating sections across all codes, this code provides the primary interpretation and guidance on the guiding principles, supported decision-making and rules for assessing the capacity of a relevant person where required by or pursuant to the Act.
