Code of Practice for Decision-Making Representatives

13 April, 2023

This code of practice provides guidance for decision-making representatives appointed by the court under a decision-making representation order to meet their responsibilities and duties under the Act by acting as their agent and making certain decisions on their behalf.

This includes following the guiding principles within the Act and working with other decision supporters and interveners. It also includes their record keeping and reporting obligations. This code applies both to decision-making representatives known by the relevant person and those appointed from the DSS panel.

This code does not cover the process for making a decision-making representation order which is set by Court Rules. However, further information on this process can be found in separate guidance in our Resources section.
